Notice of Public Hearing on 8th February

The independent examiner of the Elmstead Parish Neighbourhood Plan and accompanying
Neighbourhood Development Order, John Slater BA, DMS, MRTPI, FRGS, having read the plan,
supporting documents and representations, has considered it is necessary to call a Hearing under
the provisions of Schedule 4B of the Town and Country Planning Act 1990, as amended by the
Localism Act 2011.
The Hearing will commence at 10.00 am on 8th February 2024 at:
The Community Centre, School Road, Elmstead Market, CO7 7ET

Independent Examination

An Independent Examiner: Mr John Slater BA(Hons) DMS MRTPI FRGS was appointed by Tendring District Council to examine both the Neighbourhood Plan and NDO on the 22ndSeptember 2023. The Independent Examination of the Neighbourhood Plan and NDO started on the 9th November and the Examiner visited the Parish on the 23rd November. The Examiner submitted his initial comments on the Neighbourhood Plan and NDO to the District and Parish Council on the 27thNovember. These are fact finding and procedural matters in the whole for the two Councils to answer. The Examiner has given both parties until the 15th December to respond.

SUBMISSION TO TENDRING DISTRICT COUNCIL

The proposed Elmstead Neighbourhood Plan was submitted to Tendring District Council on 18th April 2023, for consideration against the statutory requirements set out in paragraph 6 of Schedule 4B to the Town and Country Planning Act 1990 (as amended). 

What happens now? 

  • TDC checks that the submission complies with the relevant legislation.
  • TDC runs a 6 week Regulation 16 consultation. The deadline for comments is 5pm on Monday 30th October 2023 and you can view the submission documents and comment on the plan at the link below.

  • The Plan goes to Examination and the examiner reviews all the Regulation 16 consultation responses.
  • Responses to the examiner's queries and clarifications, or less likely, a hearing. 
  • The examiner issues a fact check report which is responded to.
  • A final report is issued.
  • TDC makes a decision on the final report.
  • Final modifications are made. 
  • TDC publication of decision.
  • Referendum.
  • Adoption.
